You also understand and agree that any other method of opting out, including, but not limited to, texting words other than those set forth above or verbally requesting one of our employees to remove you from our list, is not a reasonable means of opting out.
Duty to Notify and Indemnify: If at any time you intend to stop using the mobile telephone number that has been used to subscribe to the Program, including canceling your service plan or selling or transferring the phone number to another party, you agree that you will complete the User Opt Out process set forth above prior to ending your use of the mobile telephone number. You understand and agree that your agreement to do so is a material part of these terms and conditions. Participant Requirements: You must have a wireless device of your own, capable of two-way messaging, be using a participating wireless carrier, and be a wireless service subscriber with text messaging service. 15. EXCLUSIONS AND LIMITATIONS OF LIABILITY
We do not exclude our liability to you where it would be unlawful to do so, for example, for death or personal injury caused by our negligence. The court may award injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim.

- Forums for Alternative Dispute Resolution. If You are located in, are based in, have offices in, or do business in a jurisdiction in which this Clause 18 is enforceable, the following mandatory arbitration provisions apply to You:
(i) Arbitration. If we cannot resolve a Dispute as set forth in Clause 18(A) within sixty (60) days of receipt of the notice, then either You or we may submit the Dispute to formal arbitration. If we cannot resolve an Excluded Dispute as set forth in Clause 18(A) within sixty (60) days of Our receipt of the notice, then either You or We may submit the Excluded Dispute to formal arbitration only if You and Mr.logo® consent, in a writing signed by You and an officer or legal representative of Mr.logo®, to have that Excluded Dispute subject to arbitration. In such a case, (and only in such a case), that Excluded Dispute will be deemed a “Dispute” for the remainder of this Clause 18(B).
